Changes to your medical decision maker

There has been recent changes in Victoria concerning Enduring Powers of Attorney (Medical Treatment) (Medical EPA), which took effect on 12 March 2018.

Some important matters to note are:

  1. Any existing Medical EPA’s in place before 12 March are still valid;
  2. From 12 March you can put in place any or all of the following:
    1. an ‘advance care directive’, which is a document that sets out a person’s binding instructions or preferences and values in relation to their medical treatment in the event that they are incapacitated;
    2. an ‘appointment of medical decision makers’, which is similar to the previous Medical EPAs; and
    3. an ‘appointment of support persons’ for medical decisions, which are people that can support you when you make a medical decision.
