Employers to destroy Covid-19 vax information by August 11

On 12 July 2023, the Occupational Health and Safety Amendment (COVID-19 Vaccination Information) Regulations which allowed employers to collect, record, hold and use Covid-19 vaccination information of their employees or people attending the workplace was revoked.

By 11 August 2023 Victorian employers must destroy information held pursuant to those regulations.

Covid-19 vaccine information includes information about whether a person:

  1. has received a vaccine and the date of that vaccine; or
  2. is unable to receive a vaccine due to a medical contraindication or illness.

Employers who are permitted or required under other laws to collect, use, record or hold vaccine information are not required to destroy Covid-19 vaccine information.

Employers should also note that a person’s Covid-19 vaccine information is health information protected by other legislation such as the Health Records Act 2001 (Vic).
